How to Check if a Car Has Outstanding Finance Before Buying

If a car is still on finance, the finance company may legally own it — and that does not change just because you paid the seller in good faith.

Why it matters so much

Under a hire purchase or conditional sale agreement the lender owns the vehicle until the final payment is made. If the debt is unpaid, the lender can trace and repossess the car from you, and your only route to recovering the money is against the seller — who is often long gone.

How to check

  1. Run the registration through a full history check that includes finance records.
  2. Compare the make, model, colour and VIN in the report with the actual car and the V5C.
  3. Ask the seller directly whether any finance is outstanding and note their answer.
  4. If in doubt, ask for the agreement number and contact the lender yourself.

If finance is recorded

  • Ask for a settlement letter from the finance company, dated within a few days.
  • Pay the settlement amount directly to the lender, not to the seller, and pay only the balance to the seller.
  • Get written confirmation from the lender that the agreement is cleared before you take the car.
  • If the seller resists any of this, walk away.

Records can lag behind reality. A recently settled agreement may still show, and a very recent agreement may not show yet. Treat the check as strong evidence, not a guarantee.
